Terms and conditions

1. Scope

These General Terms and Conditions apply to all orders placed via the online shop tonidental.de, operated by:

2. Conclusion of the contract

The presentation of the products in the shop does not constitute a legally binding offer (invitatio ad offerendum). By submitting your order, you make a binding offer to purchase. The offer is accepted by an order confirmation sent by email or by delivery of the goods.

3. Prices and shipping costs

All prices are final prices including statutory VAT. Shipping costs are charged in addition; they are shown in the bag and at checkout before you place your order:

Other EU countries (for delivery countries, see section 5)	€16.90 per order
Inflamaya Gel without any other items	€2.99 (Germany) or €6.99 (other EU countries)
Orders of €600 or more	free shipping

Businesses established in another EU member state that provide a valid VAT ID issued in that member state when ordering and have the goods delivered to an EU country other than Germany receive a VAT-exempt intra-Community supply (§ 4 No. 1b of the German VAT Act (UStG)) at the net price. We verify the VAT ID when the order is placed using the European Commission's VIES system; if VIES does not confirm it, statutory VAT will be charged.

4. Terms of payment

You can pay by PayPal, credit card, Klarna, Apple Pay or Google Pay. Payment is processed by our payment service provider Stripe. The amount is due when the order is placed; the goods are dispatched once payment has been received.

5. Delivery

We deliver to Germany, Austria, Belgium, the Netherlands, Luxembourg, France, Denmark, Poland, the Czech Republic, Italy, Spain and Croatia.

The delivery time is stated for each item and begins upon receipt of payment. We order most items from the manufacturer for you; they are usually dispatched within 3–7 working days. For deliveries to other EU countries, the carrier's transit time of 2–5 working days must be added. For special orders or new production runs, the delivery time may be 1 to 12 weeks.

6. Retention of title

The goods remain the property of the seller until payment has been made in full.

7. Right of withdrawal

Consumers have a statutory right of withdrawal. For details, see the cancellation policy.

8. Warranty

The statutory warranty rights (legal guarantee) apply.

9. Liability

We are liable without limitation for intent and gross negligence. In cases of slight negligence, we are liable only for breaches of essential contractual obligations, limited to the foreseeable damage typical for this type of contract. Exempt from this limitation: injury to life, body or health.

10. Applicable law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of the country in which they have their habitual residence.

11. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer conciliation body.

12. Severability clause

Should individual provisions be invalid, the validity of the remaining provisions shall remain unaffected.
